The Department of Justice has issued a subpoena to Cavite 4th District Rep. Francisco “Kiko” Barzaga to face complaints for inciting to sedition and inciting to rebellion.
The Office of the City Prosecutor of Quezon City ordered Barzaga to appear for preliminary investigation on Nov. 18, 2025 and 25 at 3 p.m. at the Justice Cecilia Muñoz Palma Hall in the DOJ Building.
The case, docketed as XV-03-INV-25K-11187, cites violations of Articles 142 and 138 of the Revised Penal Code in relation to Section 6 of Republic Act No. 10175, also known as the Cybercrime Prevention Act.
The subpoena, dated Nov. 12, 2025, directs Barzaga to submit a counter-affidavit in six copies, along with supporting documents and a government-issued identification card.
The document states that no motion to dismiss will be entertained and only counter-affidavits will be accepted.
According to the subpoena, respondents who fail to submit counter-affidavits will be deemed to have waived their right to present evidence.
The document also mandates that parties must personally appear before the investigating prosecutor.
