P12.6 Million Na Security Deposits ng Kawit LGU Nadiskobre ng COA

KAWIT, CAVITE BINULGAR: P12.6 MILYON NA DI-NAIWASANG UTANG NG LGU, PINAGDUDUDAHAN NG COA!

Isang nakakagulantang na ulat mula sa Commission on Audit (COA) ang lumitaw kaugnay ng umano’y kapabayaan at posibleng katiwalian sa administrasyon ni Kawit Mayor Angelo Aguinaldo, matapos mabunyag na halos ₱12.6 milyon na accounts payable at guaranty/security deposits payable ng lokal na pamahalaan ang nanatiling hindi na-revert sa general fund sa loob ng mahigit dalawang taon.

Ayon sa COA 2021 Audit Report, ang kabuuang halagang ₱12,639,285.22 ay binubuo ng:

  • Accounts Payable: ₱8,715,571.50
  • Guaranty/Security Deposits Payable: ₱3,923,713.72

Ang mga ito ay hindi na-liquidate at nanatiling “nakabitin” mula pa noong 2004 hanggang 2019. Ayon sa batas, dapat ay naibalik na ito sa unappropriated surplus of the general fund matapos ang dalawang taon kung walang aktwal na claim o tamang dokumentasyon.

“…any unliquidated balance of accounts payable… which has been outstanding for two years or more and against which no actual claim… has been filed… may revert to the unappropriated surplus…” – Section 98, PD 1445

Tahasang paglabag sa batas

Sa ilalim ng Section 40, Book 6 ng 1987 Administrative Code of the Philippines at PD No. 1445, malinaw na hindi dapat itinuturing na payable ang mga obligasyong walang sapat na dokumentasyon o matagal nang walang claimant.

Ngunit sa isinagawang pagsusuri ng COA, makikita na ang mga “utang” na ito ay mula pa sa mga proyekto o transaksyon noong 2004, 2007 at 2019 — isang malinaw na indikasyon ng kapabayaan, o mas malala, posibleng pagkukubli ng pondo.

Katiwalian sa likod ng “naiwang” pera?

Ayon sa ulat, ang Guaranty/Security Deposits Payable ay mga pondong nakuha bilang retention money mula sa mga kontratista at supplier — ngunit hindi pa rin inire-remit pabalik kahit lumipas na ang mahigit isang dekada.

“…same were still unclaimed as of December 31, 2021,” ayon sa COA.

Ang tanong ngayon: Nasaan ang pera? Bakit hindi na-liquidate? Kaninong bulsa ang napunuan?

Hinamon ang pananagutan ni Mayor Aguinaldo

Ang kabiguan ng administrasyon ni Mayor Angelo Aguinaldo na ayusin ang mga lumang utang at ipasok muli sa pondo ng bayan ang mga hindi na-claim na halagang ito ay nagdudulot ng malaking pagdududa sa integridad at katapatan ng kanyang pamumuno. Sa dami ng mga taon na lumipas, imposible raw na hindi ito nabigyang-pansin kung may tunay na financial control at accountability sa lokal na pamahalaan.

Panawagan para sa masusing imbestigasyon

Ikinakasa na ng mga grupo ng mamamayan at civil society organizations sa Kawit ang isang panawagan para sa isang malalimang imbestigasyon ng Ombudsman at Department of the Interior and Local Government (DILG) upang alamin kung may pananagutang kriminal o administratibo si Mayor Aguinaldo at ang kanyang mga opisyal.

“Hindi puwedeng basta na lang malilimutan ang ₱12.6 milyon na para sa taumbayan,” wika ng isang lider ng civic group. “Kung may nanamantala sa kaban ng bayan, dapat managot.”
